Terms of Service

1. Acceptance of Terms

By accessing or using MyCardRep ("the Service") at mycardrep.com, you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a binding legal agreement between you and MyCardRep. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. Continued use of the Service after any modification constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

2. Nature of the Service — Information Platform Only

MyCardRep is strictly an information and reputation platform. We provide tools that allow users to build and share trading reputation profiles, log deals, submit reviews of other traders, and submit and search reports about traders — including persons who are not registered users of MyCardRep, identified by an off-platform handle.

MyCardRep does not:

• Facilitate, broker, arrange, or participate in any transaction between users
• Handle, hold, transfer, or guarantee any payment or funds
• Verify the identity of any user beyond basic account registration
• Independently verify the accuracy of any review, deal log, report, reputation score, or profile information
• Guarantee, warrant, or insure the outcome of any transaction between users
• Act as an escrow, intermediary, or party to any transaction

All transactions, trades, sales, and deals occur entirely outside of MyCardRep between independent parties. MyCardRep has no involvement in, control over, or responsibility for any such transactions.

3. No Guarantee of Trustworthiness

CRITICAL DISCLAIMER: A user's reputation score, tier, badge, review count, the presence or absence of reports, or any other metric displayed on MyCardRep does not constitute a guarantee, warranty, endorsement, or verification of that user's trustworthiness, identity, honesty, or ability to complete any transaction.

Reputation data on MyCardRep is entirely user-submitted and unverified. MyCardRep makes no representation as to the accuracy, completeness, reliability, or timeliness of any reputation information displayed on the Service.

You acknowledge and agree that:

• MyCardRep reputation information is one tool among many and should never be your sole basis for deciding to transact with another user
• The absence of any report or review about a person is not an indication that the person is trustworthy or that dealing with them is safe; it means only that nothing has been reported
• You use MyCardRep reputation information entirely at your own risk
• MyCardRep is not responsible for any loss, damage, or harm you suffer as a result of transacting with another user, regardless of that user's reputation on our platform
• We strongly recommend using a payment method that includes a buyer and seller dispute mechanism for all offline transactions regardless of a counterparty's MyCardRep reputation

4. Eligibility

You must be at least 13 years of age to use the Service. By using MyCardRep, you represent and warrant that you are at least 13 years old. If you are between 13 and 17 years of age, you represent that you have obtained your parent or legal guardian's consent to use the Service and that your parent or guardian has reviewed and agreed to these Terms on your behalf.

MyCardRep reserves the right to terminate your account and refuse service if we have reason to believe you do not meet these eligibility requirements.

5. Account Registration and Security

You agree to provide accurate, current, and complete information when creating your account and to keep your account information up to date. You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account, whether or not authorized by you
• Notifying us immediately of any unauthorized use of your account

MyCardRep is not liable for any loss or damage arising from your failure to maintain account security. You may not share your account, transfer it to another person, or create multiple accounts for the purpose of manipulating the reputation system.

6. Prohibited Conduct

You agree not to use MyCardRep to engage in any of the following:

• Submitting false, misleading, fabricated, or fraudulent reviews, deal logs, reports, or profile information
• Artificially inflating your reputation through fake accounts, coordinated review exchanges, collusion rings, or any other manipulative means
• Submitting retaliatory, fabricated, or bad-faith reports, or reports not based on your own direct, first-hand experience
• Creating multiple accounts for any purpose, including evading a ban or manipulating reputation scores or reports
• Impersonating any person, entity, or MyCardRep itself
• Harassing, threatening, stalking, or intimidating any user or any person named on the Service
• Using information obtained from the Service to harass, threaten, dox, or target any person outside of the platform
• Posting another person's private personal information (such as a home address, telephone number, email address, or financial-account number)
• Posting defamatory, obscene, hateful, or unlawful content
• Attempting to gain unauthorized access to the Service, other users' accounts, or our systems
• Scraping, crawling, or otherwise extracting data from the Service without our express written permission
• Using the Service for any illegal purpose or in violation of any applicable law or regulation
• Interfering with or disrupting the integrity or performance of the Service
• Engaging in any conduct that MyCardRep, in its sole discretion, determines to be harmful to the community

Violation of these prohibitions may result in immediate account suspension or termination without notice, at our sole discretion.

7. User Content

You are solely responsible for all reviews, deal logs, reports, profile information, photographs, responses, and any other content you submit to the Service ("User Content"). By submitting User Content, you represent and warrant that:

• You have the right to submit the content and grant the licenses described herein
• The content is accurate and based on your genuine personal experience
• The content does not violate any applicable law, these Terms, or the rights of any third party
• Reviews and reports are based solely on transactions you personally participated in

By submitting User Content, you grant MyCardRep a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, display, reproduce, distribute, and adapt your User Content in connection with operating and improving the Service.

Reviews, deal logs, and reports may remain publicly visible indefinitely, including after account deletion, as they form part of the permanent community trust record. You understand and accept this before submitting any content.

MyCardRep reserves the right, but not the obligation, to review, monitor, remove, or edit any User Content at our sole discretion and without notice.

8. Card Board Listings

MyCardRep provides a bulletin board feature called "Card Board" that allows users to post cards they wish to trade or sell offline. You acknowledge and agree that:

• Card Board listings are provided for informational purposes only
• MyCardRep does not facilitate, broker, or participate in any transaction arising from a listing
• All sales, trades, and exchanges are arranged entirely between independent parties off-platform
• MyCardRep makes no representation as to the accuracy of any listing, the condition of any item, or the trustworthiness of any seller
• MyCardRep is not responsible for any loss, damage, fraud, or dispute arising from any transaction facilitated by a listing on this platform
• Listings expire after 30 days and may be removed at our sole discretion
• You are solely responsible for the accuracy of any listing you post

Expressions of Interest. The Service may allow you to indicate interest in one or more listings ("Expression of Interest"), optionally including a note and an indicative figure. You acknowledge and agree that:

• An Expression of Interest is not an offer, bid, acceptance, or binding commitment of any kind, and does not create any contract, agreement, or obligation between you and any other user or MyCardRep.
• Any indicative figure you include is an informal indication only and is not an offer to buy, sell, or trade at that or any price.
• MyCardRep does not facilitate, broker, host, or participate in any negotiation, communication, or transaction that may follow an Expression of Interest. Its sole function is to let the recipient know you are interested and to surface contact information so that the parties may, at their own discretion, communicate directly off-platform.
• All negotiations, agreements, and transactions are arranged solely between the parties, off-platform, and MyCardRep is not a party to and bears no responsibility for any of them.
• You are solely responsible for any Expression of Interest you submit and any communication or transaction that results from it.

9. Reviews and the Reputation System

The MyCardRep reputation system is designed to provide community-sourced information about traders. You acknowledge and agree that:

• All reviews are user-submitted opinions and have not been independently verified by MyCardRep
• MyCardRep makes no representation as to the accuracy or reliability of any review
• Reputation scores, tiers, and badges are calculated automatically based on user-submitted data and do not reflect any independent assessment by MyCardRep
• The reputation system is subject to manipulation despite our anti-fraud measures, and MyCardRep is not liable for any harm resulting from manipulated reputation data
• MyCardRep reserves the right to adjust, recalculate, or remove reputation data at any time in its sole discretion

9A. Trader Reports (Find a Collector / Community Watch)

MyCardRep provides features through which eligible, logged-in users may submit first-hand accounts ("Reports") of their experiences with other people during card transactions — including people who are not registered users of MyCardRep, identified by an off-platform handle (such as a Reddit or Instagram username). Reports, and reputation information derived from them, are publicly visible and searchable through features such as "Find a Collector." You acknowledge and agree that:

• A Report is the personal, first-hand account and opinion of the user who submits it. It is not a statement, finding, accusation, endorsement, or conclusion by MyCardRep. MyCardRep acts solely as a neutral host of user-generated content and does not verify, investigate, adjudicate, or endorse any Report.
• Whether a Report is displayed is determined by automated, objective criteria (such as the submitting user's account standing and age, the presence of photographic evidence, and corroboration by other independent users). MyCardRep does not editorially select, rank, or determine the truth of individual Reports.
• You may submit a Report only if it is a truthful account of your own direct, first-hand experience, made in good faith. You may not submit false, misleading, exaggerated, retaliatory, or fabricated Reports, or Reports based on hearsay or second-hand information.
• A negative Report must include photographic evidence. You must not include another person's private personal information (such as a home address, telephone number, email address, or financial-account number) in any Report or evidence.
• You are solely and personally responsible for every Report you submit and for all consequences of submitting it. You, and not MyCardRep, are the author and publisher of your Report. You represent and warrant that you have a lawful basis to submit any information about another person that a Report contains, and that the Report does not violate these Terms, any applicable law, or the rights of any third party. The indemnification obligation in Section 13 applies in full to Reports you submit.
• If you are the subject of a Report, you may respond by creating an account and verifying that the handle is yours, after which you may post a public response; you may also flag any Report, or request correction or removal by contacting [email protected]. MyCardRep may hide, remove, or decline to act on any Report at its sole discretion, including Reports it determines to be false, abusive, to contain prohibited personal information, or to violate these Terms.
• The absence of any Report about a person is not an indication that the person is trustworthy or that dealing with them is safe; it means only that nothing has been reported.
• Submitting a Report does not obligate MyCardRep to take any action, and MyCardRep is not responsible for any consequence arising from a Report, whether or not it acts on it.

Reports constitute User Content for the purposes of these Terms, including Sections 7, 10, 11, 12, and 13.

9B. Showcase

MyCardRep provides a "Showcase" feature for displaying cards that are not for sale. You acknowledge and agree that:

• Showcase content is provided for informational and community purposes only.
• You are responsible for the images and descriptions you upload, and you confirm you have the right to display them.
• MyCardRep may remove Showcase content that violates these Terms.
• You are solely responsible for any content you post and any arrangement you enter into through this feature.

9C. Paid Subscriptions

Features of the Service are currently provided at no charge. This is not a commitment that any feature will remain free. MyCardRep may introduce, change, or withdraw paid plans at any time, and may make existing features subject to a paid plan on notice. Where a paid subscription is offered and you subscribe, you agree to the following:

• Billing. Payments are processed by our third-party payment processor, Stripe. You authorize us and Stripe to charge your payment method for the applicable subscription fee stated at the time you subscribe, plus any applicable taxes.
• Free trials. Pro may be offered with a free trial. Unless you cancel before the trial ends, your subscription will begin and your payment method will be charged automatically at the end of the trial.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You authorize these recurring charges.
• Cancellation. You may cancel at any time from your account. Cancellation stops future renewals; you retain Pro access until the end of the period you have already paid for.
• Refunds. Except where required by law, fees are generally non-refundable. We may, at our discretion, offer refunds or credits on a case-by-case basis.
• Price changes. We may change subscription prices or features. Changes to recurring prices apply to subsequent billing periods, and where required we will provide advance notice.

9D. Referral Program

MyCardRep may offer a referral program that rewards users for inviting new members. You acknowledge and agree that:

• Referral rewards (such as free months of Pro or account credit) have no cash value, are non-transferable, and cannot be redeemed for cash except where required by law.
• You may not abuse the program, including through self-referrals, fake or duplicate accounts, or any other manipulative means. We use anti-fraud measures (including payment-method, name, and email matching) to detect and block abuse.
• We may modify, suspend, or terminate the referral program, or withhold or revoke rewards obtained through abuse, at any time and in our sole discretion.

9E. Inventory Tracker

MyCardRep provides a private "Inventory Tracker" that lets you record cards, costs, sales, trades, and expenses and generates summaries, profit & loss figures, and exports. You acknowledge and agree that:

• The Inventory Tracker is a private bookkeeping aid for your own use. Any figures, summaries, profit & loss calculations, or year-end/tax exports are estimates based solely on the data you enter and may not be accurate or complete.
• MyCardRep is not an accountant, tax advisor, or financial advisor, and nothing in the Service constitutes tax, accounting, financial, or legal advice. You are responsible for verifying all figures against your own records and consulting a qualified professional before relying on them for any tax filing or financial decision.
• MyCardRep is not liable for any loss arising from your reliance on any figure, report, or export produced by the Inventory Tracker.

10. Section 230 Notice

MyCardRep is an interactive computer service as defined under Section 230 of the Communications Decency Act (47 U.S.C. § 230). MyCardRep is not the publisher or speaker of any User Content submitted by third-party users — including reviews, deal logs, and Reports — and is not liable for any User Content under federal law. Users, not MyCardRep, are responsible for the content they submit.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MyCardRep does not warrant that:

• The Service will be uninterrupted, error-free, or free of viruses or other harmful components
• Any information on the Service is accurate, complete, reliable, or current
• The Service will meet your requirements or expectations
• Any defects in the Service will be corrected

Your use of the Service is entirely at your own risk.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYCARDREP AND ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

• Losses arising from transactions between users, including failed trades, non-payment, fraud, or non-delivery
• Losses arising from reliance on any reputation score, tier, badge, review, report, or other information on the Service
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Unauthorized access to or alteration of your account or data
• Any failure or interruption of the Service
• Any conduct or content of any third party on the Service

IN NO EVENT SHALL MYCARDREP'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MYCARDREP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless MyCardRep and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Service
• Your User Content, including any review, deal log, or Report you submit
• Any claim that your User Content is defamatory, false, or infringes or violates the rights of any third party
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third party's rights
• Any transaction you enter into with another user of the Service

14. Termination

MyCardRep reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7, 9A, 10, 11, 12, 13, and 15.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the federal or state courts located in the United States, and you irrevocably consent to the personal jurisdiction of such courts.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with your local laws. Nothing in this Section is intended to deprive you of the protection of any mandatory consumer-protection or data-protection rights that apply to you under the laws of your country of residence and that cannot be lawfully waived.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyCardRep with respect to the Service and supersede all prior agreements, understandings, and communications between you and MyCardRep regarding the Service.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.
